Happy New Year and unfair codification practices (UCP)

I wish all of you a Happy and Successful New Year!

Representing current practice of codification in Hungary we still did not transpose the UCP directive. Since both deadlines passed I am curious when the European Commission will launch an infringement procedure.

More interesting. Almost all retail banks settled in Hungary were fined for consumer deception recently (second half of 2007). The NCA did not accept arguments based on the UCP directive claiming that since the national law is not yet amended one can not rely on the directive.

I would have considered indirect effect…

Merger control conference

The Hungarian NCA (GVH) organised a very successful merger workhop in Budapest this weekend. Like we all know, there is a lot going on in merger control. Our topics were:

  • Recent interactions between academic results and practical merger policy
  • Anticompetitive vertical merger waves
  • Tacit collusion, firm asymmetries and numbers: evidence from EC merger cases
  • How to simulate the coordinated effect of a merger
  • Bargaining over remedies in merger regulation
  • Optimal merger policy

The Reform Treaty …

I do – and very so – recommend the article by Alan Riley: The EU Reform Treaty and the Competition Protocol: Undermining EC Competition Law. It was also published in ECLR 12/2007.

One can not underline how creative the CFI/ECJ can be in the interpretation of the Treaty…
